Terms & Conditions
It is mutually agreed that the following Terms & Conditions form an integral part of this contract and that no variation or modification of this contract shall be effective unless accepted by Maxim Photographic in writing:
FEE: A deposit of 20% of the chosen package is required when the Client signs this Contract. Dates are reserved only when this deposit is paid by cash or cheque. Please make cheques payable to Maxim Photographic.
PAYMENTS: A payment of the remainder of the photography fee of 60% is to be made not later than 30 days prior to the Wedding Ceremony. Payment for additional album photographs, prints & frames is made after the wedding at the time of ordering.
WEATHER CHANGES: Weather permitting, the wedding photographs will be taken as agreed. In the event of rain or snow or any form of weather disturbances, the photographer will make the necessary changes in the photographic session and will not be responsible for any disappointment caused by the weather. However, the photographer, with the co-operation of the client will do his best to produce coverage of the wedding within the time allocated to them.
PHOTOCHROMATIC ANOMALIES: Owing to reflectance caused by a combination of certain dyes and materials, especially man made fibres, it is sometimes impossible to record the exact colour of a garment as seen by the human eye. The photographer will provide a pleasing colour balance based on the flesh tones of the subjects but cannot guarantee exact colour match. The printer will use his/her skill to produce pleasing prints. Where close matching is required, we ask that you supply a fabric sample.
REQUESTED PHOTOGRAPHS: The photographer will honour all photographs requested and agreed in advance, provided the following factors are met: Weather & allocated time permitting, availability and co-operation of the person/s concerned. These photographs must form part of the client’s/parents/family/friends final wedding order.
COVERAGE: The Photographer cannot be held responsible for the lack of coverage caused by the bride, the groom or wedding party not being on time, or by Church, Register Office, or Licensed place of wedding restrictions regarding photography. The Photographers do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.
VIEWING: A mutually convenient appointment for viewing of photographs will be made upon return from honeymoon.
COPYRIGHT: The Copyright of all the photographs produced is retained by Maxim Photographic and it is a criminal offence to make copies from them by any means including video under the terms of the COPYRIGHT, DESIGNS and PATENTS ACTS 1988. Original files remain the property of the photographer. Maxim Photographic shall be the sole professional (still) photographer at the venues specified. The due performance of this contract is subject to alteration or cancellation by Maxim Photographic owing to any cause beyond their control.
LIABILITY: Every care is taken in photographing and processing using professional materials. In the unlikely event of total photographic failure or cancellation of this contract by either party, whether caused by negligence or in any other circumstance, the Photographer's liability shall be limited to a full refund of all money paid to the total value of the contract. Your statutory rights are not affected, and Maxim Gennari has full Public Liability and Professional Indemnity Insurance.
FEES: Please note that the minimum total fee due is dependant on your chosen package of which the booking fee is part. This includes all photography, expenditure (excluding travel expenses where applicable), your album, and specific package requirements. Further prints in your album are priced at £25.00 per page, irrespective or the number of prints per page.
CANCELLATION: A full unconditional refund policy exists for a period of 14 days from receipt of this contract and payment. After that date, booking fee refunds are at the discretion of Maxim Photographic. Cancellation charges will be as follows: (Number of days before the wedding) 60 days or less - 100%, 61-90 days - 75%, 91-120 days - 50%. Should the cancelled wedding turn out to be a postponement, then subject to the photographers availability, all money paid may be applied to the new wedding. In this case, the total fees chargeable shall be the fee which applies at that time. If another wedding booking has been made for your cancelled or postponed date then a full refund of deposit paid shall be made.
